Thermal imaging camera - terms and conditions
These Terms and Conditions apply to the Thermal Imaging Camera Loan Scheme (the “Scheme”. By entering the Scheme, you agree to be bound by the following terms and conditions:
- In consideration for the sum of one pound which shall be deemed paid residents of Tonbridge and Malling Borough may borrow the camera for a week. Parishes and community organisations may borrow the camera for up to one month.
- The camera needs to be picked up from and returned to the Council’s offices during council service hours Monday to Friday. Council offices are located at Gibson Building, Gibson Drive, Kings Hill ME19 4LZ, and at Tonbridge Castle, Castle Street, Tonbridge TN9 1BG. The booking confirmation will include the location, either Kings Hill or Tonbridge Castle, and the date for the collection and return of the camera.
- The personal responsible for the camera, named on the borrowing form, will need to provide photographic ID and proof of address to collect the camera.
- While you’re borrowing the camera, you’re responsible for what happens to it and for returning it to us safely. Any damage, loss or issues must be reported as promptly as possible to climate.change@tmbc.gov.uk .
- The person responsible for the camera will ensure that:
- when not in use the camera is stored in a secure, locked safe place;
- the camera is only handled and used by themselves or another member or officer of the organisation borrowing a camera, and such persons have agreed to take responsibility for the camera; and
- the camera is not provided or loaned to other members of the community or organisations by the person responsible for it.
- You agree to pay and will be charged a fee of £375 if you fail to return the camera, or the camera and all other provided equipment, including the box and charging cable, is not returned in full working order.
- You are responsible for securely packaging the camera and any other equipment, e.g. the charger, and returning it in the box it was provided in.
- Tonbridge & Malling Borough Council accepts no responsibility for any loss, damage, claim, action, costs (including legal costs), expenses and/or other harm arising whilst the borrower (s) of the camera are undertaking any actions or omitting to do any act or thing in connection with the possession and/or use of the camera and all responsibility for such loss, damage, claim, action, costs (including legal costs), expenses and/or other harm is excluded to the fullest extent permissible by law.
- Residents and organisations that have already borrowed the camera may apply to borrow it again, but preference will be given to those who have not previously had access.
- The borrowing individual or organisation, as applicable, is fully responsible for carrying out their own suitable and sufficient risk assessment and procedures for the use of the cameras, and the visiting of any premises. If in doubt:
- please do not enter anyone’s land or property, unless you are satisfied it is safe to do so. It is strongly advised that visits are undertaken in pairs, rather than by a single person. Any visits inside a property should be done as pairs for your own safety, and to help prevent the property owner making unwitnessed claims about your visit.
- you must seek the property owner’s consent before you enter the property, take any photos, take notes or register any information about the property. Any such information to be collected must be agreed in advance with the property owner as to how it will be used.
- any property specific case studies to be published must be agreed in advance with the property owner, with the property owner given the right to review and agree all text/photos prior to publication.
- The taking and storing of any information (photos, notes or other material) by the borrowing organisation must be done so in a way which is fully compatible with the UK GDPR Regulations 2021. Data protection
The personal information provided on this form will only be used for the purposes of administering and monitoring the thermal imaging camera loan scheme and this agreement. In entering into this agreement you consent to your personal information being used for these purposes. Please see our privacy notice to inform you on how we process your personal information. All of your personal information will be held and used in accordance with the UK General Data Protection Regulation (UK GDPR).
