Exemptions

Some types of buildings and extensions are exempt from Building Regulations. These exemptions apply to specific structures that meet certain size, use, and construction criteria.

Small detached buildings

You do not need approval for single-storey detached buildings if:

  • The floor area is under 30m²
  • There is no sleeping accommodation
  • The building is made mostly of non-combustible materials
    (If made of combustible materials, it must be at least 1 metre from any boundary)

Detached buildings with more than one storey may also be exempt if:

  • The total floor area is under 15m²
  • There is no sleeping accommodation

Nuclear shelters

Exempt if:

  • The floor area is under 30m²
  • The excavation is at least the depth of the shelter plus 1 metre away from any other building

Ground-level extensions

You may not need approval for ground-floor extensions under 30m² if they are:

  • conservatory or porch (glazing must comply with Part K and be separated from the main house by external-quality doors)
  • covered yard or covered way
  • carport open on at least two sides

Greenhouses and agricultural buildings

These are exempt if:

  • Greenhouses are not used for retail, packing, or display
  • Agricultural buildings are not used as dwellings, are at least 1.5 times their height from any building with sleeping accommodation, and have a fire exit within 30m of any point inside

Other exemptions

Some buildings are exempt because they are:

  • Controlled under other legislation
  • Ancillary to a main building
  • Not normally occupied by people
  • Temporary (erected for less than 28 days)
