Who carries out a Local Search?

Anyone can make a search using forms LLC1, CON29 (enquiries) and CON29O (Optional).

Alternatively, and to make it easier to submit searches direct and to reduce paperwork, we have created a downloadable Search Request form. This is a shortened version of the LLC1 form (official search of the Land Charges Register) and both of the CON29 enquiry forms. This new search request form contains all the information we require to process a search and there is no need to send an additional copy when submitting your payment. Please don't forget to attach an electronic copy of your search location plan with your application.

What area do you cover?

We cover the Borough of Tonbridge and Malling. Adjacent areas outside our borough are covered by Gravesham, Maidstone, Medway, Sevenoaks and Tunbridge Wells Councils.

How long will it take to process my search?

Most searches are completed within 7 - 10 working days as we are currently digitising our data.

Do you have an "express" service?

Yes, for an additional £58.80 your search can be expedited and we aim to return the result as soon as possible, usually within 2-4 days. Send your applications to land.charges@tmbc.gov.uk and we will begin to process your search whilst we wait for your payment to arrive. If you are a regular customer, please contact us regarding payment by BACS.

How many forms do I need to submit?

There are three official forms:

  • LLC1 - official search of the Land Charges Register
  • CON29 - Enquiries of local authority (2016)
  • CON29O - Optional Enquiries of local authority (2016)

A 'standard' search is made up of the LLC1 and the CON29 form, you can however submit any of the these forms separately.

Alternatively to make it easier to submit searches direct and to reduce paperwork we have created a downloadable Search Request form and this contains all the information we require to process a search.

All you need to do is attach an electronic copy of your search location plan and there is no need to send additional paperwork when submitting your payment.

Can I ask a question that is not printed on the CON29 form?

Yes, you can ask extra questions, by submitting a CON29O form which has 22 printed optional questions at £18 per question. You may also ask a question that is not on the form and if we can answer the question we will, but we may not have the information you want such as highway information as this comes from Kent County Council. There is a charge of £18 for every one of these extra question we answer.

Do you answer drainage questions?

No, the Water Companies deal with drainage questions on form CON29DW. Most of our borough is covered by Southern Water, but the Stansted area is covered by Thames Water.

Do I need to send you any plans of the property?

Yes, we need a plan, such as a Land Registry or Ordnance Survey based plan, with the search area clearly outlined in red, so that the boundaries of the area can be plotted accurately onto our computer system.

Does the search results cover neighbouring properties?

No, the search will be specific to the area outlined on your plan.

Does a Commercial search cost more than a Residential search?

Yes, a commercial search costs £351.80. Please see search fees.

What is a Personal Search?

A Personal Search is a personal inspection of the Local Land Charges Register and you will need to make your own notes; conditional planning decisions dated after 01/08/77 are also part of the Register and these are provided within the planning history of the search area which is given by Planning Services. What is the difference between a Personal Search and an Official search?

A Personal Search will provide you with information similar to that of an LLC1 request, but its content is your own responsibility and its accuracy is not guaranteed by the Council. LLC1 and CON29 forms are not used for a Personal Search enquiry and if you wish to ask any similar questions you must contact the other Council and County Council Services to see what information is available and whether there is a fee.

Which type of search should I choose?

Consider the implications for you and your new home if something is missed out on the search? What would you do if you found out about any restrictions on your new home, or planned developments, such as new road or rail schemes in the area, only after you'd moved in?

Moving home doesn't have to be uncertain. Make sure you ask your conveyancer about the different searches available and make sure that the search you choose provides you with the protection that you need. If you ask your conveyancer to commission new searches for you, find out what you're paying for and the risks and benefits associated with each search option.

If you have a full council search, you can rest assured that if there are restrictions or plans held by the council that could affect the value or desirability of the property, they will be revealed. A council search is certified and because your council is joined up to a national electronic search scheme called NLIS, your solicitor can even request your searches electronically.

You have a choice about what search you receive when you move home. Make sure you use it.

Cheques should be made payable to "Tonbridge and Malling Borough Council." If you are a regular customer please contact us on (01732) 876124 or at land.charges@tmbc.gov.uk to ask about payment by BACS.

Are you on the DX system?

No, unfortunately we are no longer on the DX system. Please send your search forms to: land.charges@tmbc.gov.uk or use our one page downloadable Search Request form, alternatively our postal address is: Tonbridge and Malling Borough Council, Gibson Building, Gibson Drive, Kings Hill, West Malling, Kent ME19 4LZ. All search results will be returned electronically.

Yes, the CLVG question is Question 22 on form CON29O at a cost of £18.

What is NLIS?

The National Land Information System (NLIS) is an electronic one stop shop where you can order all types of searches including coal and drainage. It was introduced in 2001 and an increasing number of applicants use this method of ordering.
