Freedom of information and data protection

You are entitled to ask the council for any recorded information that we keep. See What is the Freedom of Information Act?

Our publication scheme lists the information which we routinely make available and states whether you will have to pay for that information.

How to request information

Email your request to foi@tmbc.gov.uk and clearly state:

  • what information you want (be as specific as possible)
  • your name and address - this can be a postal or email address

You can ask to have any recorded information and in what format (for example on paper or electronically) or any particular needs relating to a disability, such as sight impairment. This could be in the form of emails, notebooks or video or audio recordings. You don't have to say why you want the information.

In most cases, we will respond to your request within 20 working days. If we cannot, we will explain why and let you know when you can expect to receive a reply.

We supply most information free of charge. However, sometimes you may have to pay a fee. You will be told in advance if this is the case.

Declining a request

We will provide you with the information unless an exemption applies, for example if your request relates to someone's personal details. We will provide you with a reason for declining your request. You can ask us to reconsider our decision using our review procedure. 

If you are still unhappy, you can ask the Information Commissioner's Office to review the decision.

Data protection statement

Your personal information will be held and used in accordance with the Data Protection Act 2018/GDPR. Your personal details will not be passed to any parties other than the Tonbridge and Malling Borough Council staff responsible for dealing with information requests.
